1. Acceptance of Terms

By accessing or using cityworthbenefit.com, the CityWorth homebuying platform, or any related services (collectively, the “Services”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Services.

2. Who Operates the Services

The Services are operated by CityWorth Properties, LLC, a licensed real estate brokerage. CityWorth Properties is affiliated with CityWorth Mortgage, LLC through common ownership. You are never required to use any affiliated company in order to use the Services. See the disclosure at the bottom of every page.

3. Eligibility & Accounts

You must be at least 18 years old to create an account. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your password. Notify us immediately at benefits@cityworth.com if you believe your account has been compromised.

4. Homebuying Dollars & Rewards

• “Homebuying Dollars” are a CityWorth-administered closing-cost credit, not legal tender.
• The usable amount of Homebuying Dollars applied at closing is capped at the lower of (a) the balance you have earned, or (b) 0.5% of the purchase price of the home you actually close on with CityWorth.
• Homebuying Dollars have no cash value, are non-transferable, and cannot be converted to cash or applied outside of a CityWorth-represented closing.
• CityWorth reserves the right to verify rewards activity and to revoke credits earned through ineligible, duplicative, or fraudulent activity.
• The rewards program may be modified or discontinued at any time, with reasonable advance notice for material changes.

5. Pre-Qualification & Mortgage Estimates

Any pre-qualification result, payment estimate, or financial figure displayed on the platform is an illustrative estimate based on the information you provide and current assumptions about rates, taxes, and insurance. It is not a mortgage approval, a loan commitment, or a guarantee of any specific terms. Actual loan offers depend on underwriting, property appraisal, and other factors, and will be issued separately by CityWorth Mortgage, LLC or another lender of your choosing.

6. Real Estate Services

Real estate services are provided by licensed agents of CityWorth Properties, LLC. Listing information, market statistics, and home valuations on the platform are sourced from third-party MLS feeds and may not be fully current. Nothing on the site constitutes a binding offer to buy or sell real estate.

7. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose, or to defraud or impersonate any person.
• Upload viruses, malware, or any content that infringes the rights of others.
• Attempt to gain unauthorized access to any account, server, or system associated with CityWorth.
• Scrape, harvest, or replicate platform data outside the user interface we provide.

8. Third-Party Services

The Services rely on third-party providers (payment, hosting, CRM, email, SMS, document analysis, MLS data). We are not responsible for the acts or omissions of those providers, but we choose vendors that contractually agree to reasonable security and confidentiality standards.

9. Disclaimers

The Services are provided “as is” and “as available.” Except where prohibited by law, CityWorth disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. CityWorth does not warrant that the Services will be uninterrupted, error-free, or that any information will be accurate or complete.

10. Limitation of Liability

To the fullest extent permitted by law, CityWorth and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of your use of the Services. Our aggregate liability for any claim relating to the Services shall not exceed the greater of (i) the amount you paid CityWorth in the twelve months preceding the claim, or (ii) one hundred US dollars.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Fairfax County, Virginia, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page and, for material changes, post a notice in the platform or email you. Continued use of the Services after a revision means you accept the revised Terms.
